Clinton man receives deferred judgment for domestic abuse charge

CLINTON — A man who assaulted the mother of his children on Christmas Day has been granted a 12-month deferred judgment.

Jonathan M. Drury, 25, 733 10th Ave. South, pleaded guilty to domestic abuse-assault causing bodily injury and received a deferred judgment and is required to pay a $315 civil penalty. He was originally charged with domestic abuse-assault with strangulation, causing injury. Drury also pleaded guilty to child endangerment with no injury and was fined $625.

According to court documents, Clinton police officers were dispatched to Drury’s residence at 9:15 a.m. Dec. 25. Officers made contact with the defendant’s live-in girlfriend and mother of two children, who was crying uncontrollably. The affidavit continues that she told officers she was assaulted in their child’s bedroom after they opened their Christmas presents.

The victim stated that Drury became very upset when their 5-year-old son accidentally dropped a portable game system on the floor, breaking it into pieces, according to court documents. Drury grabbed the child by the top of his hair and threw him to the ground, according to the affidavit.

The affidavit also states the victim told the defendant to stop and he pushed her, ripped off her shirt and threw her onto the child’s bed. Drury then got on top of her, with both of his hands wrapped around her throat and squeezed her neck until she was unable to breathe, according to court documents. An ambulance was called to the scene because she was having trouble breathing and officers noticed redness and marks around her throat.

The victim told police that when Drury released his grip from her neck, she was able to get her cellphone and call 911, according to the affidavit. He fled the scene before the police arrived and was located at the residence of family members.

A no-contact order is in place for 12 months.
