COURTS: Man pleads guilty in adult book store case

CLINTON — A man charged in the burglary of a Clinton adult book store pleaded guilty to third-degree burglary Thursday morning.

Charges against Derek W. Scheper originated from a Jan. 21, 2013, incident that left him stuck inside the wall of 18 and Beyond, 135 Fifth Avenue South. The 26-year-old defendant admitted in court Thursday to entering the business with the intent of committing a theft.

Clinton police officers were dispatched to the business at 1:48 a.m. Jan. 13, 2013, in response to an alarm going off. According to court documents, officers found that someone had kicked in the front and back doors and upon entering the store, officers found merchandise scattered on the floor and a briefcase of merchandise under a section of ceiling that had fallen. A search of the store revealed a subject, later identified as Scheper, hiding in a void of an interior wall.

According to the affidavit, officers had to tear open the drywall to reach the defendant. Scheper admitted upon his arrest that he had used a mattress found outside the building to climb through a second-story window and fell through the ceiling onto the ground. Court documents continue that after gathering some merchandise into his briefcase, he used his shoulder to force open an interior door so he could exit the same place he entered. While trying to leave, Scheper fell again, becoming trapped in a void between the interior and exterior wall.

Scheper agreed Thursday to plead guilty to third-degree burglary, a Class D felony, with the agreement that Assistant Clinton County Attorney Amanda Myers would dismiss charges of second-degree criminal mischief and possession of drug paraphernalia. His sentencing is set for 10 a.m. June 17.
