BREAKING NEWS: Cole pleads guilty to lesser charges

A Clinton man charged with first-degree murder pleaded guilty to two lesser charges this morning.

The initial first-degree murder charge was filed against Andy Cole in July 2012 for the 2008 death of Alysia Marburger, 27, of Sabula. As part of a plea agreement, this morning he pleaded guilty to a lesser charge of voluntary manslaughter, a class C felony, as well as assault with the intent to commit sexual abuse, a Class D felony.

The charge of voluntary manslaughter carries as many as 10 years in prison and a fine of between $1,000 and $10,000. Cole could be required to pay $150,000 in restitution to Marburger's estate or heirs. The Class D felony carries up to five years in prison and a fine of between $750 and $7,500. As a forcible felony, prison time is required. The charge also carries a special sentence of 10 years probation and 10 years on the sex offender registry.

The plea agreement recommends the sentences are served consecutively. Cole's sentencing is set for 11 a.m. July 11.
