No jail for man who aided escaped prisoner

CLINTON — A district court judge gave a deferred judgment to a Clinton man who aided an escaped prisoner in April.

Ty M. Hatheway, 21, 1360 Ridge Crest Drive, pleaded guilty to accessory after the fact and was given an 18-month deferred judgment. He must pay a $625 civil penalty, complete 150 hours of community service and receive a substance abuse evaluation from New Directions. If he completes all of his requirements, the charge will be dismissed.

Hatheway’s charge stems from the escape of Kendrell Keith, 18, and Kyle Julian, 18, from the Clinton County jail on April 6. According to court records, the prisoners took off running out of the east door of the law center on their way back from the recreation area.

Court records continue that Deputy Cole Hamilton stopped a westbound 2003 Chevrolet Monte Carlo registered to Hatheway on April 8, just west of Lowden on U.S. 30, because of information that Julian was in the vehicle. Hatheway was driving the vehicle and Julian was found in the back seat.

According to the affidavit, Hatheway told Sgt. Steve Cundiff that he knew Julian had escaped from county jail.

Keith and Julian both pleaded guilty to the escape. Keith was sentenced to as much as five years in prison each for the escape and a second-degree theft charge, which will run consecutively.

Julian was ordered to serve as much as five years and had his probation on two previous felony charges revoked.
