Sex abuse trial under way in Clinton

CLINTON — Prosecutors will present their case today in the trial of a Clinton man accused of sexual abusing a 3-year-old girl.

The trial against Russell S. McColley, 39, began late Monday afternoon. He is charged with second-degree sexual abuse, a class B felony that could carry as much as 25 years in prison.

According to his opening statement, Assistant Clinton County Attorney Ross Barlow hopes to prove today that on July 29, 2013, the defendant was found by his long-time girlfriend, lying in bed and naked from the waist down with her 3-year-old daughter.

During his case, he will call an expert who found a sample with McColley’s DNA in the little girl’s underwear. Defense Attorney Derek Jones did not refute these findings, but did state that they cannot prove how the DNA ended up there.

Jones told the jury a different story in his opening statement. He told the court that on the day in question the girl’s mother did not find McColley with her daughter but falsely reported that McColley abused her child because she was angry with him.

The girl’s mother will take the stand today, where even Barlow said she will have to answer some difficult questions. Both attorneys agreed that after the alleged incident the girl’s mother moved to Missouri with the defendant, with the plans to marry him.
