Woman receives deferred judgment for forgery, theft

CLINTON — A DeWitt woman charged with forgery and third-degree theft has received deferred judgments.

Amanda Chance, 20, was sentenced last week for charges that occurred in August. Judge Mary Howes agreed to give Chance a deferred judgment on both charges and two years probation.

“If you mess up, they’re going to call you back in court,” Howes told Chance.

According to the affidavit, Chance took a check from her employer’s checkbook on Aug. 14, without his knowledge or permission. She deposited it, written for $12,000, into her account at the DeWitt Bank & Trust ATM and used the money to purchase items, according to court documents. Chance admitted to stealing the check, along with another one, which was deposited at an ATM in Davenport, according to court documents. Her defense attorney, Mark Lawson, told the court that she still faces a charge for that deposit in Scott County Court. Howes said if she saw that case, Chance would receive a deferred judgment on that charge too.

Chance told the court that she is sorry for what she has done and would like to get her life back. Lawson pointed out that she has only had four speeding tickets on her record.

Howes thought a deferred judgment would be the best option so that Chance would not have a felony on her record. She added that a felony makes it difficult for a person to find employment. Howes told Chance that based on her age, it does not do the community any good to essentially sentence her to a life of unemployment.

Chance was ordered to pay restitution of $12,000 to the DeWitt bank. The civil penalties on both charges were suspended.
