CLINTON — A Clinton man has pleaded guilty to two felony charges.

Scott K. Brown, 36, 2440 Dunham St., appeared Thursday in Clinton County District Court and pleaded guilty to forgery, a Class D felony, and second-degree theft, a Class D felony. The State will dismiss one count of ongoing criminal conduct, unlawful activity, at sentencing. The plea is an open plea and no promises are made in regard to sentencing, which is set for 9:15 a.m. March 8.

According to the affidavit, between April 26 to Aug. 3, there were at least 42 fraudulent bank ATM deposits made in the city of Clinton. Multiple ATM videos showed Brown and a female conducting and/or being present during the transactions. The ATM deposits were made using eight forged checks, three checks from closed accounts, 13 pre-authorized checks with a fraudulent pre-authorization code, 11 empty deposit envelopes, five deposit slips and a check written from the same account as the ATM transaction.

The value of the fraudulent deposits totaled over $22,200. There also were 25 ATM withdrawals from the fraudulent deposits. Multiple ATM videos showed Brown and the female conducting and/or being present during the transactions. The value of the ATM withdrawals totaled $5,888.

The affidavit states an officer conducted a recorded interview with Brown on Aug. 3 at the Clinton Police Department. Brown confessed to making multiple fraudulent ATM deposits in the city of Clinton between April 26 and Aug. 3. Brown stated he would make a deposit at an ATM using the ATM card and punching in the pincode. He would then type in the deposit amount, which was not consistent with what he placed in the deposit envelope. Brown would then attempt to withdraw money from the ATM, knowing the money he was receiving was from the fraudulent deposit. Brown stated the female also helped in the fraudulent deposit scheme. The vehicle seen in most of the ATM surveillance videos was registered to Brown and the female. Brown stated the proceeds from the fraudulent deposit and withdrawal scheme went to living expenses for the family of Brown and the female.
