CLINTON — A Clinton man has pleaded guilty to a felony theft charge.
Derrick W. Apostolos, 47, 1331/2 Fifth Ave. South, appeared Thursday in Clinton County District Court and pleaded guilty to second-degree theft, a Class D felony. The State will recommend a suspended sentence, the mandatory minimum fine, applicable surcharges, costs and victim restitution at sentencing.
The court is bound to impose a suspended sentence or deferred judgement. Apostolos may withdraw his plea if the court declines to impose a suspended sentence or deferred judgement. Sentencing is set for 9 a.m. Feb. 22.
According to the affidavit, on Oct. 25, a representative of RHA Services called and reported his business received a bill from S.J. Smith Co. in reference to a welder that was charged at the store by Apostolos. The representative stated Apostolos worked for RHA Services last year and was released from RHA Services in October 2016. Apostolos had not worked for RHA since that time.
The affidavit states Apostolos also went to Paul’s Discount in Clinton on at least four occasions and charged tools and other merchandise to RHA Services.
