CLINTON — A felony willful injury charge has been dismissed against a man who was accused of striking an individual with his vehicle last month.
Clinton County District Court Judge Tom Reidel on July 9 granted the prosecution's motion to dismiss one count of willful injury causing bodily injury, a Class D felony, against Michael J. Rastrelli, 35, 3000 1/2 N. Second St. The charge was dismissed without prejudice. Costs were assessed to the State.
Assistant Clinton County Attorney Amanda Myers on July 9 filed the motion to dismiss. Myers moved to dismiss the case in the furtherance of justice, namely to get necessary statements from the alleged victim and additional people who are thought to have witnessed the alleged offense.
"Additional investigation needs to take place before the State can determine if there is an appropriate criminal charge in this matter," Myers states in the motion to dismiss.
